The migratory phenomenon has, since the last century, taken on characteristics and positions that tend to depersonalize and render the migrant subject "neutral," standardizing their respective male and female roles. Due to this flawed approach, which disregards the uniqueness of the role of migrant women, there are, therefore, "gaps" in protection that affect their specific condition, which expresses needs and requires treatments partly different from those of the male community. In Italy, with a few exceptions, there is a lack of a gender perspective on the phenomenon of migration and a human rights protection approach, which have always been conceived as universal and complementary. Analyzing the condition of migrant women has become a “new urgency” to restore their uniqueness and the possibility of differentiated protection and a path of empowerment beyond the vulnerabilities, which currently remains lacking in the Italian and international legal framework, especially in light of the ongoing compromise and oppression of the rights to which they are subjected.
